Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the PlantID Pro mobile application, website pages, and related services collectively referred to as the “Service.” The Service is operated by ASIP Technologies, Inc. (“PlantID Pro,” “ASIP Technologies,” “we,” “our,” or “us”).

By installing, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Company Information

2. Eligibility and Accounts

You must be at least 13 years old, or the minimum age required to use the Service in your jurisdiction, to use PlantID Pro. If you are under 18, you should review these Terms with a parent or legal guardian.

You may use certain features as a guest. Other features, including account-based synchronization, certain paid functionality, and subscription-linked access, may require an account.

If you create an account, you agree to provide accurate information, keep your login credentials secure, and notify us promptly if you suspect unauthorized access to your account.

You are responsible for activity occurring through your account unless prohibited by applicable law.

3. License to Use the Service

Subject to these Terms, ASIP Technologies grants you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use PlantID Pro for your personal, non-commercial use.

The Service is licensed, not sold. No rights are granted except those expressly stated in these Terms.

4. Restrictions

You may not:

  • Copy, sell, rent, lease, distribute, sublicense, transfer, or commercially exploit the Service except as expressly authorized by us
  • Modify, reverse engineer, decompile, disassemble, or attempt to derive source code from the Service except where applicable law prohibits that restriction
  • Circumvent scan limits, subscription controls, access controls, authentication, or security measures
  • Upload or submit content that you do not have the right to use
  • Submit unlawful, harmful, infringing, misleading, or abusive content
  • Interfere with the operation, security, or availability of the Service
  • Use automated scripts, bots, scrapers, or similar tools to access or exploit the Service
  • Use the Service for any unlawful purpose

5. Plant Identification and AI-Assisted Features

PlantID Pro provides plant-photo identification, plant-information features, manual plant lookup, generated plant-care guidance, and AI Plant Care Chat.

Certain features process content that you submit through external plant-identification or artificial intelligence service providers. When you choose to use an externally processed feature after granting any required permission, submitted information may be transmitted and processed as described in the Privacy Policy.

Information submitted for these features may include:

  • Plant photos
  • Plant names or related plant information
  • Manual lookup text
  • AI Plant Care Chat messages and relevant recent conversation context

The Privacy Policy identifies the external recipients that may process submitted information and explains your choices regarding future processing.

6. Plant Identification and Care Information Disclaimer

Plant identification results, plant categories, confidence indications, care information, manual lookup suggestions, and AI Plant Care Chat responses may be inaccurate, incomplete, uncertain, delayed, or out of date.

Results may be affected by factors including photo quality, lighting, angle, plant maturity, seasonal appearance, disease or damage, similarity between species, geographic variation, and limitations in automated systems or reference information.

PlantID Pro is provided for general informational and educational purposes only. It is not a substitute for professional advice.

Do not rely solely on PlantID Pro for decisions involving:

  • Poisonous or toxic plants
  • Edible plants, mushrooms, berries, herbs, or foraging
  • Medical treatment, health decisions, or emergency response
  • Veterinary decisions or animal exposure
  • Pesticide, herbicide, fertilizer, or chemical application
  • Agricultural, commercial, environmental, regulatory, or legal decisions
  • Any situation where an incorrect identification or recommendation could result in injury, illness, poisoning, animal harm, environmental harm, crop loss, or significant property damage

You are responsible for independently verifying results before relying on them.

If you or another person may have been exposed to a poisonous plant, contact an appropriate poison-control resource or emergency service immediately. In the United States, the Poison Help Line is 1-800-222-1222.

7. User Photos and Other Submitted Content

You retain ownership of photos, text, feedback, and other content that you submit through the Service.

You represent that you have the necessary rights and permissions to submit any content you provide through PlantID Pro.

By choosing to use a feature that requires submitted content, you grant ASIP Technologies a limited, non-exclusive license to receive, transmit, process, store, display, and use that content only as reasonably necessary to:

  • Provide the requested Service feature
  • Maintain your saved collection or account functionality
  • Support cloud synchronization where enabled
  • Receive and review feedback you submit
  • Operate, secure, support, and improve the Service consistent with the Privacy Policy
  • Comply with legal obligations

Submitted content may be transmitted to external service providers as described in the Privacy Policy.

Do not submit content containing identifiable people, private documents, financial information, government identification, addresses, or other sensitive personal information unless necessary for a feature you intentionally choose to use.

8. Guest, Free, PlantID Pro, and PlantID Pro Plus Access

PlantID Pro currently provides the following access levels:

  • Guest Mode: Five lifetime plant-identification scans stored on the device.
  • Free Account: Five plant-identification scans per month.
  • PlantID Pro: 100 plant-identification scans per month and 10 AI Plant Care Chat credits per month.
  • PlantID Pro Plus: 500 plant-identification scans per month and 200 AI Plant Care Chat credits per month.

Available features, limits, and eligibility requirements are displayed in the App. AI Plant Care Chat and certain other features may require both a signed-in account and an active eligible subscription.

Unused monthly scan allowances or AI chat credits do not roll over unless expressly stated otherwise in the App.

9. Subscriptions and Purchases

PlantID Pro and PlantID Pro Plus may be offered through monthly or annual auto-renewing subscriptions. Prices and subscription terms are displayed before purchase in the applicable marketplace purchase interface and within the App where applicable.

Eligible users may also purchase one-time scan top-up packs where available.

Purchases and subscriptions are processed through the application marketplace associated with your device and the version of PlantID Pro you use.

For purchases made through the iOS application, payment, billing management, cancellation, and eligible refund requests are handled through Apple and your App Store account.

For purchases made through the Android application distributed through Google Play, payment, billing management, cancellation, and eligible refund requests are handled through Google Play and your Google Play account.

PlantID Pro receives subscription or purchased-access status needed to provide eligible paid access. ASIP Technologies does not receive or store your full payment card details.

Auto-renewable subscriptions continue until cancelled. You can manage or cancel eligible subscriptions through the App Store or Google Play account used for the purchase.

A PlantID Pro account may be required for subscription-linked access, synchronization, restoration, or other paid account features. Guest users may remain eligible for available one-time scan top-up purchases where offered in the App.

10. Saved Collection, Cloud Synchronization, and Account Deletion

PlantID Pro may allow you to save identified plants, plant information, images, reminders, or related collection content.

Guest information may remain locally on the device. If you create or sign into an account, supported saved information may synchronize through cloud services so that it can be accessed across supported devices.

Deleting the App from your device does not automatically cancel subscriptions or delete account-synchronized information.

Where account deletion is available in the App, deletion removes eligible account-linked information in accordance with the Privacy Policy and applicable technical or legal retention requirements. Deleting an account does not automatically cancel a subscription managed through the App Store or Google Play. You remain responsible for cancelling subscriptions through the marketplace account used to purchase them.

11. Weather and Google Maps Platform Features

If you enable location access, PlantID Pro may provide local weather information to support plant care. Weather information is informational only and may be unavailable, delayed, incomplete, or inaccurate.

PlantID Pro includes weather-related features and content provided through Google Maps Platform, including the Google Maps Platform Weather API. Your use of Google Maps features and content through PlantID Pro is subject to the then-current:

If you enable watering reminders, reminders are provided for convenience only. You remain responsible for determining appropriate care for each plant.

12. Feedback and Suggestions

PlantID Pro may allow you to submit feedback, bug reports, identification concerns, feature suggestions, or screenshots.

If the App offers a feedback-reward program, any reward eligibility is subject to the stated program rules, review requirements, limitations, availability, and termination rights. Feedback rewards are separate from App Store or Google Play reviews and are not offered in exchange for positive public ratings or reviews.

You grant ASIP Technologies the right to use feedback, suggestions, improvement ideas, and non-confidential comments you voluntarily submit to improve, maintain, market, or develop the Service without compensation or attribution to you.

This section does not transfer ownership of your submitted plant photos or other personal content except for the limited rights necessary to operate the Service as described in these Terms and the Privacy Policy.

13. External Services

PlantID Pro relies on external services to provide certain features, including plant-identification processing, AI-assisted functionality, cloud storage and synchronization, weather information, public plant-reference information, and marketplace billing.

Your information may be transmitted to external service providers as described in the Privacy Policy.

We do not control the availability, accuracy, terms, or independent conduct of external services. Service interruptions, changes, or errors affecting an external provider may affect PlantID Pro functionality.

14. Intellectual Property

Except for content that you submit and external materials used under applicable rights or licenses, PlantID Pro and the Service, including software, branding, designs, user interfaces, text, graphics, workflows, functionality, and related materials, are owned by or licensed to ASIP Technologies and are protected by intellectual property laws.

These Terms do not grant you any ownership interest in PlantID Pro, the Service, or related intellectual property.

15. Changes to the Service

We may update, modify, suspend, restrict, or discontinue all or part of the Service, including features, limits, subscriptions, pricing, supported devices, or external-service-dependent functionality.

Where changes affect an existing paid subscription, we will comply with applicable marketplace requirements and applicable law.

16. Termination

You may stop using PlantID Pro at any time.

We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, attempt to circumvent access controls, create security or legal risk, or where termination is otherwise permitted by applicable law.

Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitations of liability, indemnification, dispute provisions, and governing law, will survive.

17. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

ASIP TECHNOLOGIES DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND FITNESS OF IDENTIFICATION OR CARE INFORMATION FOR ANY SPECIFIC USE.

WE DO NOT WARRANT THAT:

  • THE SERVICE WILL OPERATE WITHOUT INTERRUPTION OR ERROR
  • ANY PLANT IDENTIFICATION, CARE INFORMATION, MANUAL LOOKUP RESULT, OR AI CHAT RESPONSE WILL BE ACCURATE OR COMPLETE
  • ANY WEATHER INFORMATION OR REMINDER WILL BE ACCURATE OR TIMELY
  • THE SERVICE WILL MEET YOUR PARTICULAR REQUIREMENTS

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASIP TECHNOLOGIES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, BUSINESS OPPORTUNITY, PRIVACY, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASIP TECHNOLOGIES WILL NOT BE LIABLE FOR ANY INJURY, ILLNESS, POISONING, ANIMAL HARM, ENVIRONMENTAL HARM, PROPERTY DAMAGE, CROP LOSS, OR OTHER LOSS RESULTING FROM RELIANCE ON A PLANT IDENTIFICATION, CARE RECOMMENDATION, MANUAL LOOKUP RESULT, AI CHAT RESPONSE, WEATHER RESULT, OR REMINDER.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  • The amount you paid to PlantID Pro through eligible purchases during the twelve months preceding the event giving rise to the claim; or
  • Fifty United States Dollars (US $50).

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless ASIP Technologies and its officers, directors, employees, affiliates, licensors, and service providers from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:

  • Your violation of these Terms
  • Your unlawful use of the Service
  • Content you submit without necessary rights or permission
  • Your violation of another person’s rights

20. Copyright and Intellectual Property Complaints

If you believe content associated with PlantID Pro infringes your intellectual property rights, contact support@plantid.pro with sufficient information for us to review the request, including your contact information, identification of the claimed work, identification of the allegedly infringing material, and a statement of your authority to submit the request.

21. Informal Dispute Resolution

Before starting a formal dispute, you and ASIP Technologies agree to attempt to resolve the matter informally for sixty days.

A notice of dispute must include the name and contact information of the party submitting the notice, the basis of the dispute, and the relief requested.

Notices to ASIP Technologies must be sent to support@plantid.pro.

22. Binding Arbitration

Except for disputes eligible for small claims court and claims seeking injunctive or equitable relief concerning intellectual property, unauthorized access, security, or misuse of the Service, any dispute that is not resolved through informal resolution will be resolved by binding arbitration to the extent permitted by applicable law.

Arbitration will be administered under the applicable rules of the American Arbitration Association unless another procedure is required by applicable law.

By agreeing to arbitration, you and ASIP Technologies agree to resolve covered disputes without a judge or jury and waive the right to participate in a class action or class-wide arbitration for covered disputes, to the extent permitted by applicable law.

Either party may bring an eligible individual claim in small claims court or seek temporary or preliminary relief from a court of competent jurisdiction where necessary to protect rights or property while arbitration is pending.

23. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles, except where applicable consumer law requires otherwise.

For disputes not subject to arbitration, claims seeking permitted injunctive or equitable relief, enforcement of an arbitration award, or proceedings otherwise allowed under these Terms, you agree to the exclusive jurisdiction of the state or federal courts located in Delaware, unless applicable law provides otherwise.

24. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date above.

If a change is material, we may provide notice through the App, website, email, or another appropriate method. Your continued use of the Service after updated Terms become effective means you agree to the updated Terms, except where applicable law requires additional consent.

25. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

26. Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that provision or any other provision later.

27. Entire Agreement

These Terms, together with the Privacy Policy, Subscription Policy, Privacy Choices page, and any additional terms presented for specific features or purchases, constitute the entire agreement between you and ASIP Technologies regarding the Service and supersede prior agreements regarding the same subject matter.
